Acceptance of These Terms
Apna Bazar Woburn (“Apna Bazar,” “we,” “us,” or “our”) operates our website, mobile web, and mobile applications, and any future sites that link to these Terms (collectively, the “Application”). By accessing or using the Application and services offered through it (the “Services”), you agree to these Terms of Service (the “Terms”) and our Privacy Policy (the “Privacy Policy”). If you do not agree, do not use the Application.
About the Application
The Application enables registered users to browse, order, pay for, and arrange pickup or delivery of grocery items and related goods. Available features, programs, fees, and product offerings may change at any time at our discretion.
Eligibility & Your Account
- You must be at least 16 years old to use the Application; if you are under the age of majority (generally 18), you must use the Services only with the consent of a parent/guardian, who may be responsible for your activities.
- You agree to provide accurate, complete information and to keep it current.
- One personal account per individual. You are responsible for maintaining the confidentiality of your login and all activities under your account.
- We may suspend, limit, or terminate access to the Application at any time, with or without notice, for any reason.
Privacy, Data Security & Breach Notification (Massachusetts)
We process personal information as described in our Privacy Policy. We maintain a written information security program and implement administrative, technical, and physical safeguards intended to protect Massachusetts residents’ personal information as required by 201 CMR 17.00 and M.G.L. c. 93H (including breach-notification obligations). Electronic Records & Communications
You consent to receive notices and communications electronically (e.g., email, in-app, or posting on the Application). Contracts and signatures may be created and executed electronically and are enforceable under MUETA (M.G.L. c. 110G) and the federal E-SIGN Act. Massachusetts Legislature+1
License & Ownership
The Application, including content, software, and all intellectual property, is owned by Apna Bazar or our licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Application for personal, non-commercial grocery shopping. You may not copy, scrape, index, modify, create derivative works, publicly display, or resell content or Services without our express written consent.
Acceptable Use
You agree not to: (a) use bots, scrapers, or automated methods to access the Application; (b) upload malware or interfere with the Application; (c) attempt to gain unauthorized access; (d) overload or disrupt our infrastructure; (e) misrepresent your identity or affiliations; (f) collect others’ data without consent; or (g) use the Services for any unlawful purpose.
Ordering, Substitutions, Pickup & Delivery
- Order acceptance. Your order is an offer; we may accept, reject, or limit quantities. Product availability, images, and descriptions may vary by store and may change without notice.
- Substitutions. You may opt in/out of substitutions. We’ll attempt a comparable item if you opt in; price adjustments may apply.
- Age-restricted items. Where legally sold online, we may verify age/ID on pickup or delivery and may refuse to complete a sale if verification fails.
- Delivery windows & fees. Delivery areas, windows, and fees are disclosed at checkout and may vary.
- Risk of loss. Title and risk of loss pass upon pickup or upon delivery to your designated location (including unattended delivery).
Pricing, Taxes & Fees (Massachusetts)
- Prices, promotions, and fees may change and may differ from in-store pricing.
- Massachusetts tax rules apply. In general, many grocery foods for home consumption are exempt from MA sales tax; however, certain products and prepared foods may be taxable (including applicable local meals taxes), and delivery/other charges may be taxable when associated with taxable items. Taxes and fees are calculated at checkout based on your order composition and delivery/pickup location.
- Coupons and promotions are subject to terms and may not be combined or applied to previous purchases.
Returns, Refunds & Order Issues
- Perishables (e.g., fresh produce, dairy, refrigerated/frozen items): report issues within 2 hours of delivery/pickup for replacement or refund at our discretion.
- Non-perishable, unopened items: return within 7 days of receipt with proof of purchase; we may require photos or return of the item.
- Incorrect/shorted items: report within 24 hours of receipt.

Gift Cards & Store Credit (Massachusetts)
Apna Bazar gift cards and store credits issued for returned merchandise are valid for at least seven (7) years from issuance, subject to applicable law. User Content (Reviews & Feedback)
If you post reviews or other content, you grant us a worldwide, royalty-free license to use, reproduce, modify, and display that content for operating and improving the Services. You are responsible for your submissions and represent that they are lawful, accurate, and non-infringing. We may remove content at our discretion.
Third-Party Services
The Services may integrate with third-party delivery, payment, or analytics providers. Those services are governed by their own terms and privacy policies. We are not responsible for third-party acts or omissions.

Disclaimers
THE APPLICATION AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT). We do not warrant uninterrupted or error-free operation, or that product information (including nutrition/allergen data) is complete or current. Always check labels before consumption.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL APNA BAZAR OR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS (US $100).
Indemnification
You agree to defend, indemnify, and hold harmless Apna Bazar and our affiliates from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of law or third-party rights.
Intellectual Property & DMCA
Our names, logos, product images, and content are protected by copyright and trademark laws. If you believe content infringes your rights, you may send a DMCA notice to our designated agent at: [DMCA Agent Name], [Address], [Email].
Suspension & Termination
We may suspend or terminate your account or access to the Services at any time, with or without notice. Upon termination, Sections intended to survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution) will remain in effect.
Dispute Resolution; Governing Law; Venue; Class Waiver
- Governing law. These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflicts rules, and by applicable federal law (including the Federal Arbitration Act).
- Informal resolution. Contact us first; we’ll try to resolve complaints promptly.
- Arbitration. Except for small-claims or injunctive relief, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by JAMS (or AAA if JAMS is unavailable) under its commercial rules. The seat and venue will be Middlesex County, Massachusetts. Each party bears its own fees unless the arbitrator awards otherwise. No class or representative actions; disputes will be arbitrated on an individual basis only.
- Time to bring claims. To the extent permitted by law, any claim must be filed within one (1) year after it accrues.

Modifications to the Services or These Terms
We may update these Terms or the Services at any time. Changes are effective upon posting (or as stated). If you continue using the Services after changes post, you accept the changes.
Severability; No Waiver
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
Assignment
You may not assign any rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Apna Bazar regarding the Services and supersede prior or contemporaneous agreements relating to the Services.
